Child Abuse Central Index Cases (CACI Cases)

What is the California Child Abuse Central Index?

The child abuse central index is a listing of all persons who have been suspected, accused, or alleged to have committed child abuse, including emotional abuse, whose names appear on the California Department of Justice Child Abuse Central Index.  This list is updated continually and the names of the persons on the list remain for a period of 10 years.

How does the listing of my name on the Child Abuse Central Index affect me?

Different governmental agencies are able to access the list including child welfare agencies, law enforcement agencies, county probation departments, department of social services community care licensing division, county adoption agencies, and others. Even if you have not been convicted or charged with any crime of child abuse, your name may remain on the child abuse central index listing for up to a period of 10 years.

This can result in some serious consequences. You may be prevented from obtaining a job, prevented from adopting a child, or could affect your ability to maintain custody of your child or children.

How Can I Get My Name Off of the Child Abuse Central Index (CACI) Listing?

When the county child welfare agency plans to list someone on the child abuse central index, an individual is entitled to request a Grievance Hearing where that person gets a chance to contest the allegations against them. The hearing is not in a court room with a judge but is in a less formal setting. At the hearing, the county social workers present their side of the case and that individual may present their side including witnesses. Also at the hearing, your child abuse central index attorney can represent you and question the social worker assigned to your case as well as the supervising social worker.
