Claims Filed Against School Districts For Negligence in Failing To Protect Student From Sexual Abuse

Riverside County prosecutors recently filed 16 felony charges against former Riverside Unified School District and Val Verde Unified School District teacher/administrator, Andrea Cardosa, after one former student recorded a phone call with the administrator and posted that phone call on YouTube. In that YouTube video, the administrator allegedly admits to causing damage and says, “I regret it every day. Every day.” Her bail has been set at $5 million. Cardosa is being charged with with 15 felonies, including lewd acts with a child and five counts of aggravated sexual assault on a child, which can carry up to a life sentence, if convicted.

Recently, attorneys Michael S. Carrillo, Luis Carrillo, and John Henrichs filed a claim against the two school districts alleging that the school districts were negligent for failing to protect one such student, Brianna. The claim further alleged that the former educator “groomed” Brianna by giving her special treatment including giving her movie tickets, candy bars and lunch trips, and ultimately making several sexual advances and inappropriately touching the girl.

“‘From early on, nothing was done to protect her,’ South Pasadena-based attorney Michael Carrillo said of his client, an 18-year-old Perris resident named Brianna who claims to have been victimized by a former educator in 2009-2010 when Brianna was a student at Tomas Rivera Middle School in Perris.”
